This Agreement (hereinafter referred to as "the Agreement") is a legal agreement between you and VRA Retail and Food Solutions Private Limited (hereinafter referred to as "VRA" or "Freshpick"); the sole owner of the brand "Freshpick and&nbsp;<a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">www.fresh-pick.in (https://order.fresh-pick.in/)</a>
This Agreement states the terms and conditions under which you may receive services from Freshpick and use the&nbsp;<a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">www.fresh-pick.in</a> (<a href="https://order.fresh-pick.in/">https://order.fresh-pick.in/</a>) web site (hereinafter referred to as "Freshpick service").
If you use Freshpick. service, you agree to these terms and conditions.
<h4>FRESHPICK Co. SERVICE</h4>
Freshpick service is a transaction, information and communication service available to authorized users ("customers") who access&nbsp;<a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">www.fresh-pick.in (https://order.fresh-pick.in/)</a>
Freshpick service currently provides an online shopping and delivery service for seafood's, meats, poultry, dairy and other related food items, and may in the future provide additional products and services.
Freshpick's employees, agents or designees will deliver orders placed with Freshpick service. Prices of products sold online may differ from those in retail stores. Delivery will be made to the delivery address that you specify when you confirm your order. Prices for products you place in your cart will be fixed for the transaction, unless otherwise mentioned.
Payment for shopping and processing/delivery fees (if applicable) will be due on or before the time of delivery. You are responsible for ensuring that someone is present at the delivery address to receive and pay for deliveries at the specified time of delivery. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive and pay for the order. If Freshpick cannot deliver your order, or must make an additional delivery because no one is at the delivery address to receive and pay for the order at the specified time, or wrong address / details given to us by you, will be assessed an additional fee.
If you are not satisfied for any reason with an item purchased through Freshpick. service, you may call customer service at the time of receiving your order or afterwards on +91 9699 933 330.
Freshpick.'s liability for missing a delivery is limited to delivery at a later agreed time at no additional charge or refund of the amount received from the customer for that particular order.
Pricing:
All the products listed on&nbsp;<a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">www.fresh-pick.in</a> (<a href="https://order.fresh-pick.in/">https://order.fresh-pick.in/</a>) will be sold at MRP or selling price unless otherwise specified. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities do change on a daily basis which would be updated almost immediately on the portal.
Cancellation Policy:
Please refer to the terms and conditions elaborated in the Shipping, returns and cancellations page. However, if there are changes in the delivery slot time you requested or need to add more products, you need to call us on customer care number +91 9699 933 330.
Please note:
If we suspect any fraudulent transaction by any customer or any transaction which defies the terms &amp; conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

We reserve the right to correct online pricing errors. In such event, we reserve the right to correct the pricing error or cancel undelivered orders for such incorrectly priced products. You will be contacted in such circumstances. If any change is unacceptable to you, you may cancel your order and / or Freshpick service and expressly terminate this Agreement.

You agree to defend, indemnify and hold Freshpick and its Associates harmless from any claims and expenses, including attorney's fees, arising in connection with a violation of this Agreement by you or through use of your account.

Your privacy is very important to Freshpick. Aggregated Information.&nbsp;<a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">www.fresh-pick.in (</a><a href="https://order.fresh-pick.in/">https://order.fresh-pick.in/</a><a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">)</a>&nbsp;may use aggregated information regarding its customers and usage of Freshpick Service (such as customer demographics and traffic patterns) and disclose such aggregated information to advertisers, partners and others for various purposes.
Third Party Service Providers. Freshpick may employ other companies and individuals to perform certain functions such as delivering packages and analysing data. They may have access to personal information to perform their functions.
Sale of Business. Freshpick may transfer Customer Registration Data and other personal information in connection with the sale of <a href="http://www.fresh-pick.in/" target="_blank" rel="noopener">www.fresh-pick.in</a> (<a href="https://order.fresh-pick.in/">https://order.fresh-pick.in/</a>)or the sale or transfer of its business operations in your geographic area to a third party provider of ordering or delivery services who agrees to be bound by this Privacy Policy until you consent that such information will be governed by the policies and terms of such third party provider.

 Q. What is Normal Delivery?
A.&nbsp;Normal delivery is for next day requirements of customers. It shall be executed as per the below terms:

<li>Minimum order amount for Normal Delivery is INR 300/- and for all locations.</li>
<li>A packing and processing charge/delivery charge of INR 25/- shall be applicable for all orders irrespective of amount and locations</li>
<li>We shall endeavour to deliver as per the abovementioned slot timings. However, the same shall be subject to availability and unavoidable circumstances.</li>

Q. What is the Express Delivery?
A.&nbsp;Express delivery is for same day requirements of customers. We charge a nominal charge of INR 50 for express deliveries. Order will be delivered in 2 hours to your location from the time the order is placed subject to product availability. It will be valid only for ordering window from 10.00am &ndash; 7.00pm over the phone.
Q. Will you deliver an order outside your selected delivery areas?
A.&nbsp;Typically, we do not accept orders outside our delivery area. However, if you are residing outside the mentioned delivery areas on mobile app and website, please feel free to call us on +91 9699 933 330 and we will try our best to fulfil your requirement.
Q. What are the phone timings for order placement?
A.&nbsp;We accept orders 24 hours over the website/ mobile app subject to delivery slots and from 9.00am to 8pm all seven days of the week over the phone.

<h4>FRESHPICK RETURN AND REFUNDS POLICY</h4>
We have a no question asked return/refund policy in case the goods are &lsquo;damaged&rsquo; or &lsquo;expired&rsquo; at the time of receipt at delivery address.
Please note that, the meaning of &lsquo;damaged&rsquo; is limited to foul smell, bruised or discolouration for Fresh Chilled products and to foul smell, bruised, thawed or discolouration for Fresh Frozen Products.
We insist that you check all the items at the time of receipt. The item is non-returnable in nature due to consumable /hygiene /wellness natures of product. However, in the unlikely event of damaged, defective, or different item delivered to you, we will provide a full refund or free replacement as available and applicable. We may contact you to ascertain the damage or defect in the product prior to issuing refund/replacement. We shall not be responsible to refund or return for goods once accepted at the delivery address.

We take all the care with the help of our superior cold chain technology to maintain the freshness and quality of our products right up to your doorstep, hence we implore you to consume the products on the same day itself to relish the best quality and taste.
We take care that all the products go under strict scrutiny by our Quality team; However, in a rare case scenario, if you find the Quality of the product not as per the promised mark by Freshpick, please contact our Customer Support team and we will give a complete replacement/ refund of the order.&nbsp;
All quality complaints will be undertaken if we receive the complaint within 24 hours of the products being delivered to you.
If the fresh chilled products are stored in your freezer and they are kept in the frozen state instead of chilled state, we do not assure you of its freshness in terms of taste and texture. We maintain 0-4 degrees of temperature for the Fresh chilled range of products at all times. If the fresh frozen products are not appropriately stored (at or below -18Deg C) and or thawed wrongly, we do not assure you of its freshness in terms of taste and texture
We may contact you to ascertain the damage or defect in the product prior to issuing refund/replacement. Given that the orders are lower in size and it is hard to refund for cash on delivery orders in particular, the refunds will be applied to the subsequent shopping bills. Expired products will not be considered under this offer.
If a complaint is accepted, Freshpick will initiate a refund of the full value of the Product found to be unsatisfactory. Freshpick representative may collect the concerned Product from the delivery address mention in the order details. Refund in wallet will be made within 24 hours. Credit Card refund will take 15 days and all other payment modes will take 5-7 days. Freshpick&rsquo;s decision, with respect to the Response, shall be final and binding.
At all times, Freshpick&rsquo;s liability lies only and for the whole and complete order amount under any litigations. Any litigations will be under the jurisdiction of and in the legal courts falling under Mumbai Jurisdiction only.

<h4>FRESHPICK CANCELLATION POLICY</h4>
Given the nature and perishability of our product range with relevance to maintain the quality of freshness of the products; we follow the below mentioned Cancellation policy.
A Customer can opt to cancel order within 1 hour for the order placed either online or by calling our customer service and receive refund of advance paid if any.
If the order has been processed and cut as per customer&rsquo;s requirements, the order cannot be cancelled due to the perishable nature of our products.
Once the order is delivered and accepted by the customer at the delivery location, there is No Cancellation that is possible.
This is not applicable for Express delivery orders since those are processed and shipped immediately.
Freshpick reserves the right to cancel any order if it suspects any fraudulent transaction by a Customer or breaches the terms &amp;amp; conditions of our website or mobile app.
